Terms and Conditions

These Terms and Conditions for the use of this website, which will be referred to as “Terms” hereinafter, come into effect from June 15, 2021, with the following details:

  1. Definitions

Within these Terms:

  • (a) “Application” refers to the application named ‘work application,’ available at https://wworkthailand.co.th/download/, operating in the sale of motorcycle accessories and parts.
  • (b) “Website” refers to the website named ‘wworkthailand’ located at www.wworkthailand.co.th, which operates and provides services as follows: Offers news and promotions about the work application.
  • (c) “Owner of the website and application” is W Work (Thailand) Company Limited.
  • (d) “User” means any visitor, user, or member of the website and application, or any other person who accesses the website and application, regardless of the method, nature, device, channel of access, and whether or not there is a cost involved.
  • (e) “Personal Data” means any information, whether belonging to the user or any other person, that can be used to identify that individual, directly or indirectly.
  • (f) “Products” means any products offered for sale in the application.
  • (g) “Content” means text, articles, comments, analyses, images, symbols, logos, computer graphics, photographs, animations, films, sounds, audio recordings, designs, commands, command sets, or communications in any form and by any means in the website and application, regardless of whether the content is access restricted or not.

2. Permission to Use the Website and Application

The owner of the website and application has opened the website and application for use under these Terms, and users who wish to use the website and application have read and understood the statements and conditions of these Terms in detail and have agreed to the conditions set forth in these Terms in full. In this regard, the owner of the website and application hereby grants users the right to use the website and application under the conditions of these Terms.

3. Usage Guidelines

         For users to achieve optimal performance and experience, users may use the website and application as determined by the owner of the website and application as follows:

         Users will be able to order motorcycle accessories and parts according to the desired model. Accumulate points after purchasing products to redeem for discounts or rewards.Contact the technical department for assistance with installation issues or usage problems.

4. Prohibited Uses of the Website and Application

In any case, users agree not to use the website or application, either directly or indirectly, in any of the following manners:

(a) Perform any act that is contrary to the law, court judgments, or orders from the government or state agencies.

(b) Perform any act that may disrupt public order or customs.

(c) Perform any act that infringes intellectual property rights, copyrights, trademarks, patents, rights to reputation, personal rights, and other rights of the website and application owner or others.

(d) Perform any act that leads to the collection, disclosure, or provision of personal data unlawfully.

(e) Perform any act that interferes with the functioning of the server systems, command sets, or network systems of the website and application.

5. User Accounts

        In using the website and application, the owner of the website and application may provide user accounts for each user as requested on a case-by-case basis. The owner of the website alone has the right to approve the opening of user accounts, determine the type of user accounts, set access rights to data for each account type, any costs associated with user accounts, and the duties and responsibilities of the users who own those accounts.  

         Users agree to keep their usernames, passwords, and any information strictly confidential and agree not to allow, and make every effort to prevent, others from using their user accounts.

         In cases where a user’s account is used by another person, the user agrees and assures that such use by another person is as the user’s agent and binds the user as if they themselves had performed the act.

6.   Collection and Use of Personal Data of Users 

            In using the website and application, users acknowledge and agree to allow the website and application owner to collect, process, and use their personal data provided to the website owner, including personal information such 

            as names, surnames, and telephone numbers. 

            This personal data of users will be used for purposes such as maintaining customer data for product development, services, and presenting appropriate advertisements matching customer needs. Users have the right to access, delete, edit, modify, transfer, or refuse their personal data provided to the website owner, and at any time, users may withdraw consent to the collection and use of their personal data, provided that it does not conflict with the law or the rights of the website owner. 

             In cases where the website or application owner uses personal data of users, the website owner agrees to use such data only to the extent that it does not cause damage, distress, and annoyance to the data owner and will not disclose such data to external parties in a manner that could identify the user data owner, unless it is used and disclosed as required by law or by an order from a government agency.

7. Assurances and Duties of Users

In using the website and application, users have duties and provide assurances to the website owner to make their utmost effort to comply with the duties of users and the conditions of these Terms as follows:

(a) Users have read and understood the statements and conditions of these Terms in detail and agree to the conditions set forth in these Terms in full.

        (b) Users understand and acknowledge that these Terms are a contract that is binding and enforceable under the law between the website or application owner and the user.

        (c) Users will take any necessary and appropriate actions to ensure their employees, subcontractors, assistants, consultants, or any representatives (if any) strictly comply with these Terms.

        (d) In cases where others make claims or bring lawsuits against users, or users are sued due to the use of the website or application, users will settle these claims at their own expense and responsibility, and users agree to make their utmost effort to prevent the website and application owner from being involved in the process of settling such claims.

(e) In cases where the website or application owner incurs damages or expenses due to or arising from the use of the website by users, users agree to fully compensate the website and application owner for such damages or expenses.

9. Violation of User Terms

        In the following cases:

            (a) Users violate these Terms, the assurances given by users in these Terms, or any guidelines that the website owner has informed users, whether generally or specifically.

            (b) Users use the website for illegal purposes or in ways that disrupt public order.

            (c) Users engage in any activities that may cause damage to the website, the website owner, other users, or external parties.

            (d) Users engage in any activities that the website and application owner deems inappropriate.

The website and application owner, at their sole discretion, may take the following actions:

            (a) Send an official warning to users to correct such actions or behavior.

            (b) Suspend the use of the website and application for a certain period, which may or may not have a specified duration, without prior notice.

            (c) Revoke the right to use or access the website and application, without prior notice.

In cases where the website and application owner suspends or revokes the right to use or access the website and application as per these Terms, users acknowledge and agree that the website and application owner is not liable for any loss, damage, claims, liabilities, or expenses arising from or related to such actions according to these Terms.

10. Website and Application Availability

Users agree and acknowledge that the website and application owner may suspend the operation of the website or application, either entirely or partially, temporarily or permanently, without any obligation to compensate for any damages that may occur to users in the following cases:

(a) Maintenance of tools and equipment necessary for operating the website, including but not limited to server maintenance.

(b) Updating and developing the system and commands related to website operation, including but not limited to website updates and firmware updates.

(c) Inoperability of tools, equipment, or command systems related to website operation, whether owned by the website owner or external parties.

(d) Force majeure, including but not limited to electrical system failures, communication system breakdowns, accidents, disasters, fires, natural calamities, strikes, enactment or amendment of laws, or government orders.

11. Reporting Problems and Behavior

Users may report any problems with the website and application, including but not limited to website or application errors, command issues, behaviors of other users that do not comply with these Terms, or activities that may disrupt public order, oppose good morals, support violence, or cause disturbance to other users, at marketing@wworkthailand.co.th.

13. Disclaimer of Liability

Users agree and understand that no part of these Terms, or within the website and application, explicitly or implicitly guarantees the stability, reliability, accuracy, completeness, effectiveness, suitability for a specific purpose of the user, safety, or error-free nature of the website and application. Furthermore, the website and application owner:

(a) Is not responsible for any damages that occur to users while using the website or application, including but not limited to damages to equipment, systems used by users to access the website and application, or loss of user data, reputation, and rights, unless such damages result from intentional acts or gross negligence of the website and application owner.

(b) Is not liable for damages resulting from user actions, whether intentional or not.

(c) Is not liable for damages resulting from external party actions, including but not limited to unauthorized access (Hackers) and computer criminals.

14. Intellectual Property

Users acknowledge and understand that all intellectual property rights, including but not limited to the website content, copyrights, patents, trademarks, service marks, trade names, or designs, any system used on the website or application, regardless of duration, are the sole property of the website and application owner. Users have a revocable, non-transferable right to use the intellectual property, as long as the website and application owner permits, under the terms of these Terms only. At no time do these Terms, explicitly or implicitly, transfer any intellectual property rights to users, either directly or indirectly.

15. Confidentiality

       In using the website and application, users may become aware of or receive information from the website/application owner or other entities for the use of the website and application, which is not publicly disclosed or intended for public disclosure at the time of disclosure. Users agree to keep the information of the website/application owner or the information received from the website/application owner confidential, whether it is personal information or business information, regardless of its value. This information shall not be disclosed, published, announced, or disseminated to third parties, except as required by law, government agency orders, or with prior written consent from the website owner.

16. Amendments

       The website and application owner may modify the terms of these Terms at any time, in whole or in part. The website and application owner will notify users of any changes each time they occur. The modified agreements are considered part of these Terms

17. Finality of Terms

These Terms represent the final agreement between the contracting parties. Any endorsements, understandings, discussions, or negotiations prior to these Terms that contradict or conflict with these Terms are superseded by these Terms.

18. Severability of Terms

If any part of these Terms is found to be void, incomplete, or unenforceable for any reason, the contracting parties agree that other terms and agreements within these Terms remain valid and binding as if the void, incomplete, or unenforceable parts did not exist in these Terms.

19. Notification

Users agree that notifications or documents that the website and application owner must send to them under these Terms are considered delivered when sent to users in the following manner: announced on the website’s user interface.

20. Governing Law

These Terms are governed by the laws of Thailand.

21. Dispute Resolution

If disputes or conflicts arise from these Terms and the contracting parties cannot reach an agreement, they agree to submit the dispute to the courts in Thailand.
