Privacy Policy

This Privacy Policy (“Policy”) takes effect for the first time on June 15, 2021, and is detailed as follows:

  1. Definition

(b) “Data Controller”: The manager or owner of the website, W Work (Thailand) Company Limited

(c) “Data Processor”: External individuals processing data for or on behalf of the Data Controller

(d) “Data”: Represents various forms of information

(e) ”Personal Data”: Information about an individual that can identify that person directly or indirectly

(f) “User”: Individuals who access or use the Website

  1. Tracking User Behavior on the Website

Given that the website and application owner has made the website and application available for use under these terms and conditions, and users wish to use the said website and application, by using the website and application, users have read, understood, and agreed to all the statements and conditions of these terms. Accordingly, the website and application owner hereby grants permission to users to use the website and application under the conditions set forth in these terms..

2.1 The Data Controller may use cookies to provide services to users or in relation to accessing the website’s platform.

(b) Users may request the data controller to send or transfer their personal data or related information to another data controller, including requesting information that has been sent or transferred directly from the data controller who sent or transferred such data.

  1. When the data controller collects, uses, or discloses personal data of the user out of necessity for the lawful benefit of the data controller or another person, and the user has proven their rights override those of the data controller.
  2. When the user, as the owner of the personal data, has withdrawn consent for the collection, use, or disclosure of their personal data, and the data controller no longer has legal authority to collect, use, or disclose the personal data.
  3. When the user has lawfully objected to the collection, use, or disclosure of the data.
  4. When the personal data has been collected, used, or disclosed unlawfully against the laws, regulations, or rules on personal data protection.

(d) Users may request the data controller to suspend the use of their personal data while retaining it in the following cases:

  1. When the data controller is being inspected by the expert committee under the personal data protection law, which the user has requested for such inspection.
  2. When the personal data has been collected, used, or disclosed unlawfully against the laws, regulations, or rules on personal data protection.
  3. When the user needs to keep their personal data to exercise their legal rights, including establishing a legal claim, performing or exercising legal rights, or raising or fighting legal claims.
  4. When the data controller is in the process of proving or inspecting to deny the user’s lawful objection to the collection, use, or disclosure of personal data.

(e) Users may file a complaint with the expert committee under the personal data protection law in cases related to the violation or non-compliance with the laws, regulations, or rules on personal data protection by the data controller.

5. Collection, Use, and/or Disclosure of Personal Data under the Personal Data Protection Law

Users acknowledge and agree that the data controller may collect, use, and/or disclose user data without prior consent from users, only as necessary and only for the purposes and in the cases as follows:

(a) To achieve purposes related to the preparation of historical documents or archives for public benefit or related to research or statistics, which have appropriate measures to protect the rights and freedoms of personal data.

(b) To prevent or suppress harm to the life, body, or health of any person.

(c) Necessary for the performance of a contract where the user is a party, or to take steps at the user’s request before entering into such a contract.

(d) Necessary for the performance of a public task or exercise of official authority vested in the data controller.

(e) Necessary for the lawful benefit of the data controller or another person, where such interest significantly outweighs the fundamental rights of personal data of the user.

(f) To comply with the law of the data controller.

The data controller will record the collection, use, or disclosure of personal data of the user as mentioned above.

6: Website Use by Persons under User’s Guardianship or Custody

The user assures that they are not, and agrees to allow individuals with the following characteristics to visit, use, or become a member of the website:

(a) Incompetent persons who are under the user’s guardianship.

(b) Persons who are akin to incompetent individuals and are under the user’s custody.

In cases where the user consents to such persons as mentioned above to visit, use, or become a member of the website, the user agrees to consider that they have exercised their powers of guardianship, custody, or protection, as the case may be, in agreeing and consenting to this policy in its entirety, and on behalf of such persons.

7. Transfer of Personal Data Abroad

The data controller has no policy to transfer data abroad.

8. Complaints and Reporting Problems Related to Personal Data

Users may file complaints and report problems related to personal data, including but not limited to requesting the data controller to correct, update data to be current and/or accurate, object to data collection, or suspend data usage, through the following channels:

Unless otherwise specified by the personal data protection law, the data controller will record important transactions related to storage, use, or disclosure of data in writing or electronically for inspection by the user or state agencies, including but not limited to the following:

(a) Collected personal data.

(b) Purpose of collecting each personal data.

(c) Information about the data controller.

(d) Duration of personal data storage.

(e) Rights and methods to access personal data, including conditions for those who have access to personal data.

(f) Collection, use, or disclosure of personal data that is exempted from the user’s consent.

(g) Denials and objections.

(h) Details about measures to maintain data security.

10. Policy Amendments

The data controller may amend and change the contents of this policy at any time, in whole or in part, and will notify the users when changes are made, so users can review and accept them electronically or by other means. If it is found that the user has acted to accept, it is considered that the amended policy is part of this policy.

11. Governing Law

This policy is subject to the laws of Thailand.

12. Dispute Resolution

In case of any dispute or conflict arising from this policy, if the parties cannot reach an agreement, they agree to bring the dispute to the courts in Thailand.
